Where can I get a Medical Marijuana Card in California in 2018?

 

In 2018, you still can either get your medical marijuana ID either online or at any licensed doctor's office.  Even your family doctor could prefer that you  go online, because many physicians would still like to remain officially anonmyous.

 

SHOULD I GET A STATE MARIJUANA I.D. CARD?

Patients don't have to get an ID card to be covered by California Marijuana laws, but a State ID card may provide an extra measure of protection against arrest. Patients and caregivers can obtain state ID cards through the health departments of the county where they live or online.   Often, the online solution is cheaper and faster.

This state ID card system still has safeguards to protect patient privacy. Cops and employers cannot track down patients through the registry system.  The Patient's’ ID Center in Oakland offers ID cards for all California residents that are recognized by most collectives and police. Additionally, online doctors offer ID cards that may be verified.

DOCTOR'S OFFICE

If you have a great family doctor, who is an expert in medical marijuana, you're good to go.  But, even if you are so blessed, your doctor might prefer to have his patients simply go online to get their required MMJ paperwork done for a variety of reasons.

Oftentimes, the doctor is not familiar with the State process and it might take some time for him to process your request, or he might not even agree to having his patients take marijuana.  Some doctor's may agree that medical marijuana is a valuable medicine, but they don't want to have any documents that show they prescribe it.  The reason being, the Federal Government is still anti-marijuana and could potentially discriminate against doctors in the future.  

For example; businesses that deal with marijuana are not allowed to use much of the banking system, and this could easily extend to a doctor that is "doing business" in the area of medical marijuana.

Whether you go online or to a clinic, your medical marijuana recommendation must be made by a California Licensed Physician.  Under State Law, a physician may write a recommendation for any condition or symptom that cannabis might provide relief.  Tough diseases such as AIDS, cancer, multiple sclerosis, glaucoma, chronic pain, definitely qualify.  Other, less serious conditions like anxiety, stress, headache might qualify too, and this depends on the doctor's opinion.

  • You can purchase, possess and consume marijuana in California, but no other state except Nevada.
  • You can give away marijuana to your friends of legal age.
  • You can possess varies from county to county. If your county does not have a higher limit.
  • Generally, you may possess 8 ounces of cured cannabis, six plants in (mature) flowering, or up to twelve plants in the (immature) vegetative state. No city or county can adopt lower limits lower but they can adopt upward.  
  • Marijuana consumers should keep ontop of local rules and regulations.


 

WHAT YOU CANNOT DO

 

  • You can't transport marijuana across state lines.
  • You cannot sell marijuana.
  • You cannot possess, consume, or transport in Federal lands or facilities.
  • You cannot possess, use, or transport more than an oz at a time (or up to 8 ounces in some areas).

Yes.  That is if they are residents of California.  A California resident is simply any individual who is present in California for other than a temporary or transitory purpose.

If you are a marijuana consumer and travel in California, if you are stopped by a Federal official you could very well be deported for any quantity of marijuana.  You better get your Medical marijuana card now.

Yes and no.  The Feds may bust you on Federal lands and facilities.  The Feds may try to bust you anywhere for marijuana offences, but this is extremely rare and unheard of at the medical marijuana patient level.  Functionally and realistically, if you are acting within state laws concerning marijuana, and are not on Federal real estate, then problems with the Fed drop to zero.

If you have a medical marijuana ID card, the the California Highway Patrol will not take cannabis from motorists at routine traffic stops.

Patient names and addresses are not kept in the state's data base: the only information retained is a personal photo and Identification - ID number. **. I get drug tested at my job. may I use marijuana?   Not necessarily. The California Supreme Court ruled that employers may discriminate against medical cannabis users. The legislature passed a bill to change that in 2008, but Gov. Schwarzenegger vetoed it. See: California Health and Safety Code .......  No professional licensing board may impose a civil penalty or take other disciplinary action against a licensee based solely on the fact that the licensee has performed acts that are necessary or appropriate to carry out the licensee's role as a designated primary caregiver to a person who is a qualified patient or who possesses a lawful identification card ......

May I take my cannabis on a plane?   TSA officials have indicated that flying within the state with under an ounce of cannabis is permitted, though it is not known at this time how far the different airports have gone to explicitly implement Prop. 64. TSA policy is to turn cannabis cases over to local law enforcement. There’s nothing they may charge people for if they have under an ounce, but still Cal NORML cautions against openly revealing their cannabis to authorities......


**. I am traveling to another state. may I use my California medical cannabis card or recommendation there?   Arizona and Montana have reciprocity in their medical cannabis laws. Maine allows out-of-state patients to exercise their rights for 30 days. Rhode Island respects out-of-state recommendations for any "debilitating medical condition." Michigan accepts medical cards from states that also have reciprocity (California's doesn't). Vermont allows recommendations from neighboring states for Vermont residents only.


**. May I use cannabis on federal land in California?  cannabis users and medical cannabis patients are not protected while on federal park land or forest land in California. NORML has received reports of campers and those driving through federal land who are searched, charged with federal possession statutes, and had their medicine confiscated. A California medical recommendation is not a defense in federal court to these charges.


**. I am coming to California. may I use medical cannabis there?   Only with a California doctor's recommendation. Most require residency. Also, collectives generally require a California ID. California's laws don't have reciprocity with other states' medical cannabis laws.


 

**. Is hashish covered under the medical cannabis laws?  Qualified patients may use and make hashish lawfully under state law. California appeals court ruled that concentrated cannabis qualifies as medical cannabis under the Compassionate Use Act. This doesn't really mark a change in policy; but since some courts and DAs have been reluctant to respect the AG's opinion, it's good to have an appellate court rule this way......

**. May I use medical cannabis while on probation or parole?   Yes, unless the judge specifies that you cannot under the terms of your probation, which you may appeal. You may request that the judge affirm your use of medical cannabis or modify the terms of your probation to allow medical cannabis use. See People v. Tilehkooh established that it is state, not federal law that governs this .......

**. May I grow or use cannabis with children in the house?  There is nothing in state law against this. However it's advised to keep your medical cannabis away from children, duh. Especially edibles this is a real danger.  Butane hash-making equipment and chemicals is a red flag for authorities.  In rare cases Child Protective Services has become involved, mostly in cases with large plant numbers.....

May I own or buy a gun if I use marijuana?  The federal Bureau of Alcohol Tobacco and Firearms sent letters to gun dealers in 2011 warning - you cannot sell guns to known cannabis users.  Answering  "Are you an unlawful user of, or addicted to, marijuana?" makes you ineligible to purchase; falsely answering no is in principle punishable as perjury. This does not affect current gun owners. Best not to keep guns in a location that is separate from their marijuana.

**. May I lose my housing if I use or grow marijuana?  The US Dept of Housing and Urban Local housing authorities may determine their own policies regarding medical cannabis use in their housing..... Landlords may make conditions on tenancy that exclude medical cannabis cultivation or use.....
