A Medical Marijuana (MMJ)  ID Card is a state issued identification that enables a patient with a doctor's recommendation to purchase, obtain, possess, or cultivate cannabis for personal medicinal use in California.  Adult residents can now complete the entire process online - in minutes - using a legal Telehealth Service Provider.

 

A MMJ ID card is valid for 12 months and may be renewed.

 

To become a medical marijuana patient adult residents need:

  • a State Driver's License or State ID
  • a valid doctor's recommendation for an eligible medical condition.

 

HOW MUCH CAN I POSSESS OR GROW?

Under Prop. 215, patients are entitled to grow a reasonable amount of marijuana to treat their personal medical conditions and symptoms. Patients can be arrested, cited or fined  if they exceed reasonable amounts. They can also be cited or fined for exceeding local county limits. Under MMRSA, effective Jan. 1, 2016, patients with Recommendations and ID Cards can cultivate up to 100 square feet for personal medical use, and primary caregivers with five or fewer patients can cultivate up to 500 square feet.  Patients should check with their  local government to find about local rules and regulations relating to growing Medical Cannabis.

 

What are MMJ Card Holders Legal Rights

MMJ-ID Card Holders are protected under the Compassionate Use act - MMP - California Department of Public Health  Section 11362.5 states the law in terms of Medical Marijuana.

 

"SB420, went into effect on January 1, 2004 as California H&SC 11362.7-.83. This law broadens Prop. 215 to transportation and other offenses in certain circumstances; allows patients to form medical cultivation “collectives” or “cooperatives”; and establishes a voluntary state ID card system run through county health departments."  - CalNorm

 

To ensure that seriously ill Californians have the right to obtain and use marijuana for medical purposes where the medical use is deemed appropriate and has been recommended by a physician who has determined that the person's health would benefit from the use of marijuana in the treatment of cancer, anorexia, AIDS, chronic pain, spasticity, glaucoma, arthritis, migraine, or any other illness for which marijuana provides relief; and

 

To ensure that patients and their primary caregivers who obtain and use marijuana for medical purposes upon the recommendation of a physician are not subject to criminal prosecution or sanction."

 

Furthermore, Health and Safety Code section 11362.5(c) provides strong protection for physicians who choose to participate in the implementation of the Act. "Notwithstanding any other provision of law, no physician in this state shall be punished, or denied any right or privilege, for having recommended marijuana to a patient for medical purposes."

  • Cancer
  • Chemotherapy Side Effects
  • Chronic Pain
  • Fibromyalgia
  • Glaucoma
  • HIV-AIDS
  • Migraine Headaches
  • Multiple Sclerosis
  • Radiation Therapy Side Effects

 

Doctors also have the right to recommend MMJ for other conditions such as Epilepsy, Chronic Stress, and any other disorder, that, in their opinion, might be beneficial for the patient.
